  1. SUPPLY TERMS

1.1     These are the terms and conditions relevant to the Products we offer and supply.

1.2     The above terms and conditions and policies are hereby incorporated by reference and together are the agreement (“Agreement”) between us and you in terms of the provision of Products and related services.

1.3 These terms:

1.3.1 Limit our risk or liability or the risk or liability of a third party; and/or

1.3.2 Create risk or liability for you (as a Consumer); and/or

1.3.3 Compel you to indemnify us or a third party; and/or

1.3.4 Serves as an acknowledgement, by you

1.4 By the sending of Data Messages or clicking on “I accept” or “Register”  or “Submit” or “Continue to Payment” demonstrates your acknowledgement and agreement to these T&C’s (where applicable).

1.5 By placing an order with MatrixCart, you acknowledge that you are 18 years of age and where you are under the age of 18 that you are placing your order with the consent of your legal guardian / parent.

1.6 Kindly note that we, and any applicable third party, shall not be liable if such Products are not available or are not available at the particular price when you complete or attempt to complete the purchase

1.7 If we cannot accept your order, (even after receipt of your payment), we will inform you of this and will not charge you for the Product(s). This might be because the Product is out of stock, unexpected limits on our resources which we could not reasonably foresee or plan for, an error in the price or description of the Product or because we are unable to meet a delivery deadline or performance date you have specified.

1.8 MatrixCart services are solely for the promotion and sale of our products only in South Africa. Unfortunately, we do not accept orders where the delivery address is outside South Africa.

2.2 If we have to contact you we will do so by telephone or by writing to at the email address, postal address or other electronic communication facility address you provided to us in your Purchase Order.

2.3 Communication includes Emails, Data Messages, and other electronic means. You acknowledge that all agreements, authorizations or requests on our website satisfy the “writing” requirement as per section 12 of the ECT Act.

  1. PRODUCTS

3.1 Products images are for illustrative purposes only. We cannot guarantee that a device’s display of the colors accurately reflects the color of the products and may vary slightly from those in the images.

3.2 Product packaging may vary from that shown on images displayed.

3.3 Stock of all Products presented is limited. We will make all reasonable efforts to discontinue presenting the Product on our website or show “out of stock” as soon as stock is no longer available. However, should items still be presented on our website after the remaining stock is sold, we will only be liable to refund any monies paid by you. STOCK AVAILABILITY NEEDS TO BE QUERIED PRIOR TO ANY ORDER BEING PLACED REGARDLESS OF WHAT THE STOCK QTY SHOWS.

3.4 All Products sold by MatrixCart come with a supplier warranty.

3.5 You will be required to produce a valid TV license and ID document when purchasing a TV. In terms of the Broadcasting Act and Television License Regulations, license holders are required to take note of and/or comply with the following: Statutory obligations pertaining to a television license must be adhered to.You will be required to produce a valid TV license and ID document when purchasing a TV.   1. DELIVERY

4.1 Products will be delivered to you only after we have received payment reflection into our bank account. No products will be delivered even with a Proof of payment document.

4.2 Products will be delivered to you within 7-30 working days.

4.3 We are not liable for any delays in timeous delivery of your Products where such delays are caused by events outside our control

4.4 Courier will deliver the product at a physical address only no P.O Box during business hours (08:00 – 17:00, excluding public holidays and weekends). It is your responsibility to ensure that the address as set out in your order is correct.

4.5 Products delivered, received, accepted and signed for with the Courier indicate that you are satisfied with the quality and quantity of said product and you have indeed received the correct product. It is your responsibility to ensure that the purchaser is the one in receipt of the ordered product.

5.1 Summary of your key legal rights

The CPA provides that goods must be as described, fit for purpose and of satisfactory quality (free of any defects) and useable and durable for a reasonable period of time, having regard to the use to which it may normally be put. During the expected life of your Product your legal rights entitle you to the following:

  .  You may return the Products to us under written notice, without penalty and at our risk and expense, if the Products fail to satisfy the standards presented. We may then, at your direction, either:

      Replace the damaged, spoilt, unsafe or defective goods; or

      . Refund to you the price paid for the Products.

      The above rights are subject to the following:

      . We are given a reasonable opportunity to inspect the Products;

     You deliver the Products

      That subsequent to delivery of the Products, the Products were not altered or utilized (including stored) contrary to the instructions;

      Fair wear and tear; and

     Where any negligent- or wilful conduct by you or any third party resulted in the defect of the Products.

TAKE NOTE: The above rights shall not apply in terms of Products delivered under contract between you and the manufacturer or goods provider directly, in which case the manufacturer warranty (if any) or good provider’s warranties will apply.

5.2 MatrixCart operates in terms of the requirements of the Consumer protection Act and our terms and conditions policy is aligned with it.

  • Should you wish to return any item received from an online purchase, it is your responsibility to return it to a MatrixCart store, with the original invoice and all the packaging and accessories. MatrixCart will not be liable to collect the goods from you that have been delivered to you for any reason whatsoever. MatrixCart will not be held responsible for any costs that may be incurred by you as a result of returning the product. This includes, but is not limited to, loss of income, loss of revenue, or any travel expenses.
  • MatrixCart will accept goods back for credit within 48 hours of delivery if it is in exactly the same state and condition that it was when it was originally supplied to you. This includes but is not restricted to all packaging and accessories.
  • Most goods that are defective when purchased or fail due to a manufacture fault will be swapped out, credited or exchanged within a 7-30 working day period from receipt of product.
  • Excluded from the swap out are –
    • Items that were purchased by special order arrangement
    • Software
    • Consumables
    • Any items that show sign of misuse or abuse
    • Goods that are susceptible to power surges
    • Accidental damage
    • Goods that cannot be comprehensively tested in store by a MatrixCart technician due to suppliers warranty policy such as printers, monitors, modems, speakers, scanners, laptops, tablets and uninterrupted power supply units. These goods will be sent to the original suppliers for testing. No repair, refund or replacement will be issued before the testing or a detailed report issued of the items is complete and has been reviewed by the authorized repair Centre. MatrixCart will not be held responsible for loss of any nature that may occur during this period of testing and assessment whether it is loss of earnings, travel, warranty or any other cause.
  • Warranty on all goods will not be valid at all if the serial number has been removed, altered, modified, damaged, erased or marked in any way whatsoever.
